SONALI Bank Limited has recently published its promotion policy-2017 wherein an ambiguity or confusion regarding court case related clause has been revealed. As per clause 7(ka), an employee who is involved in any kind of court case (without mentioning the types of court and nature of the case -- civil/criminal), will not be treated as eligible for promotion.
I would like to quote a provision in this connection which has been invoked in CCS (CCA) rule 1965, clause 12.1(3) (vigilance manual, chapter-5) of India, wherein it was clearly mentioned that in the event of an employee's promotion who is a--
"government servant in respect of whom prosecution of criminal charges is pending or sanction for prosecution has been issued or a decision has been taken to accord sanction for prosecution", his case will be placed before the departmental promotion committee (DPC) for necessary action.
So it is expected, on the part of the bank, to further clarify the court case related clause 7(ka) in order to make the Promotion policy-2017 ambiguity-free.
