High Court questions ACC notification ending inquiry into Tangail man's graft charges

The High Court has issued a ruling asking the concerned bodies of the government to explain in three weeks as to why the Anti-Corruption Commission (ACC) notification ending an inquiry process against a ruling party man in Tangail on charge of embezzling T R-Kabikha fund should not be declared illegal.

The Anti-Corruption Commission’s chairman, commissioners, director (observation and evolution), deputy director (inquiry and investigation), and deputy director of Tangail district integrated office have been asked to comply with the ruling. 

The High Court bench of Justice Md Nazrul Islam Talukder and Justice K M Zahid Sarwar passed the order after hearing a writ petition filed in this regard on Monday.

Barrister M Ashraful Islam, a Supreme Court lawyer and a resident of Delduar upazila in Tangail district, filed the petition challenging the notification of the ACC that ended the inquiry process against Shibly Sadik, a day before.

Advocate Syed Mamun Mahbub appeared in the court on behalf of the petitioner, while advocate Sazzad Hossain represented the ACC.

Barrister M Ashraful Islam said, “An allegation of embezzling Tk 2.7 million of a TR and Khabikha project was raised against Delduar upazila Awami League general secretary M Shibly Sadik. Later some reports were also published in different newspapers regarding the issue.”

“Following the reports the ACC started an investigation over the allegation and after completing the investigation the Anti-Corruption Commission on January 25 in 2018 dropped the name of Shibly Sadik from the charge and declared an end of the inquiry process.”
