HC orders recovery passwords of Evaly’s server, locks from ex chairman

The High Court (HC) on Tuesday ordered former chairman of e-commerce platform Evaly Limited Shamima Nasrin and CEO Mohammad Rassel to give all passwords of Evaly’s servers and electronic combination locks to the court appointed managing director of the company Mahbub Kabir Milon.

The jail authorities have been asked to facilitate the court appointed managing director to recover the passwords from the former chairman and CEO of the company as both of them are now in jail in different cases filed over misappropriation.

The High Court bench of Justice Muhammad Khurshid Alam Sarkar passed the order after hearing a petition filed in this regard.

Meanwhile, the same HC bench adjourned a petition filed by 30 consumers of the company to get back of their invested money worth Tk 19.1 million as the court earlier asked the customers or creditors of the company not to insist upon the newly formed Board of Directors for refund of their money in next six months.

However, the court asked the consumers to approach first to the court appointed board. And if the consumers have any grievance after approaching the board then they are asked to come to the court for remedy.

Barrister Pallob Kabir M Humaun and Barrister Syed Mahsib Hossain appeared in the court on behalf of the consumers.

The High Court earlier has asked the customers or creditors of the Evaly Limited not to insist upon the newly formed Board of Directors or Management of the organization for refund of their money in next six months.

However, now the customers are directed to contact the Head Office of Evaly to settle their issues, the court also said in its order by which it had recently formed a five-member body to run the organisation.

Justice Muhammad Khurshid Alam Sarkar passed the direction in a full text of an order released recently. Following a petition filed under the Companies Act, the High Court bench passed the short order over the issue on October 18.

The customers shall be at liberty to approach the company bench of the High Court during the pendency of the case, the full order also read.
