Evaly's former CEO, chairman allowed to transfer 50pc shares to family members

The High Court allowed tainted e-commerce marketplace Evaly’s ex-chairman Shamima Narsin and former CEO Mohammad Rassel to transfer 50 per cent of their shares to three family members, adding relatives cannot transfer or sell any share to any person.

The family members are: Shamima Nasrin’s father Rafiqul Alam Talukder, her mother Farida Talukder Lily and her sister’s husband Md Mamunur Rashid. 

As both Shamima and Rassel are behind bars, the HC directed the involved DIG prisons to cooperate in the share transfer process. 

The HC bench of Justice Muhammad Khurshid Alam Sarkar passed the order on Thursday after hearing an application filed by the three family members. 

In the application, they asked the HC to allow Shamima and Rassel to transfer some of their shares to them. 

The court also said that the court-appointed board of Evaly will determine the role of Rafiqul, Farida and Mamunur in the company, adding they must cooperate fully with Evaly’s auditors to carry out their work. 

The court directed Ehsan Sarwar Chowdhury, former executive director of Evaly, to extend his full cooperation, which he promised he would earlier before the court, to the auditor. 

The court also summoned Sheikh Salauddin, owner of the house where Evaly’s office is located, to appear before the court on February 24, adding law enforcers will be directed to arrest him and produce before the court if he fails to show up. 

Shamima and Rassel hold 80 per cent and 20 per cent of Evaly’s shares, respectively, said lawyer Tapas Kanti Baul who appeared before the court on behalf of the Registrar of Joint Stock Companies and Firms. 

Earlier on February 7, the same court asked fathers, mothers, sisters, brothers, sons, daughters in law of Rassel and Shamima to show cause within two weeks as to why all types of bank accounts of the fathers, mothers, sisters, brothers, sons, daughters-in-law of Rassel and Shamima shall not be frozen. 

Following a petition filed by a customer the same High Court bench on September 22 last year directed the concerned bodies to be restrained from selling, transferring or otherwise disposing of the assets of the Evaly till disposal of the case filed with the High Court. 

Later the court on October 18  formed a 5-member body to oversee the overall management and the company affairs of Evaly Limited. 

The court-appointed Justice Shamsuddin Chowdhury Manik, a former judge of the Appellate Division of the Supreme Court, as the chairman of the company and Mahbub Kabir Milon, an additional secretary of the government, as the ex officio managing director. 

Lawyers Shamim Ahmed Mehedi appeared in the court on behalf of the petitioners, while Tapas Kanti Baul appeared for the Registrar of Joint Stock Companies and Firms and Syed Mahsib Hossain represented the customers.
