Actors Rafiath Rashid Mithila and Sabnam Faria filed petitions with the High Court seeking anticipatory bail in a case filed by one of the customers of the controversial e-commerce platform Evaly Limited.
The two bail petitions were submitted on Sunday in the concerned section of the High Court. These petitions will be heard in the High Court bench of Justice Jahangir Hossain and Justice Md Atoar Rahman.
Mithila’s petition may come up for hearing on Monday, her lawyer Niaz Murshed said. But it was not known when Faria’s petition will be heard.
A disgruntled customer, Saad Sam Rahman, filed the case with Dhanmondi Police Station on December 4, bringing fraud charges against nine accused including three celebrities, Tahsan Khan, Rafiath Rashid Mithila and Sabnam Fari, on the charge of embezzling Tk 0.318 million.
The accused list also includes the former chairman of Evaly Limited Shamima Nasrin and CEO Mohammad Rassel.
Tahsan was the Chief Goodwill Officer of the Evaly, and Mithila was the face of the company's lifestyle products. Sabnam was the Head of PR, Media, and Communication at the Evaly.
The Evaly customer claimed that he had ordered products worth hundreds of thousands of taka from Evaly, which were never delivered to him.
Complainant Saad Sam Rahman said he trusted the e-commerce platform seeing the involvement of the celebrities with the company. He then ordered a motorcycle worth Tk 0.318 million, but did not get it despite reaching out to Evaly several times, said the case statement.
Faria’s lawyer Jesmin Sultana said, “The charge brought against Faria is baseless. She had no involvement with any kind of money transaction. The plaintiff showed the date of occurrence as May 2 in 2021. But Faria joined Evaly on June 1. As a result, the case cannot proceed against Faria.”
All the three celebrates earlier said that they had left the Evaly after fraudulent allegations were raised against the company.
