The High Court on Tuesday summoned an Additional Deputy Commissioner (ADC) and Upazila Nirbahi Officer working in Lakshmipur over sentencing former civil surgeon through mobile court.
A two-member HC bench of Justice Kazi Rezaul Haque and Justice Mohammad Ullah asked the them, ADC Sheikh Morshedul Islam and UNO Kamruzzaman, to appear before the court at 10:30am on December 13 to place their explanations.
Earlier on Monday, former Civil Surgeon of Laxmipur Dr Salahuddin Sharif was sentenced to three months imprisonment by the mobile court, led by Sadar Upazila Nirbahi Officer (UNO) Kamruzzaman, for allegedly assaulting Sheikh Morshedul.
The court came up with the order following a writ petition filed over the matter by Supreme Court lawyers Advocate Kamal Hossain Niazi and Advocate Ashfaqur Rahman.
The HC also issued a rule asking the authorities concerned to explain why the misuse of the mobile court out of personal grudge should not be declared illegal.
Former civil surgeon Dr Salauddin and Morshedul went to kindergarten Kakoli Shishu Angan in the district town to pick up their grandson and son respectively around 10:15am.
According to UNB, the duo locked into a brawl following shoving at the crowded school gate. At one stage of brawl, the ADC slapped the retired civil surgeon and he also retaliated by doing the same.
Later, police detained Dr Salauddin and produced him before the mobile court which handed down the verdict.
Meanwhile, a Laxmipur court on Tuesday granted bail to the former civil surgeon on a bond of Tk 5,000.
Mir Shawkat Ali, additional district magistrate (ADM), passed the order after Rasel Mahmud Manna, lawyer of Dr Salahuddin Sharif, filed the bail petition in the morning.
