HC rules over creating opportunity for lecturers of degree level colleges

The High Court (HC) has issued to explain in four weeks as to why the government should not be directed to give the opportunity for applying for the monthly payment order (MPO) facility to the lecturers and other employees of the pass courses of the degree level private colleges.

It also wanted to know from the respondents to explain as to why they should not be directed to give MPO facility to the lecturers and other employees of the pass courses of the degree level private colleges.

It also wanted to know in the rule as to why the condition of having minimum two departments in a degree level (pass) private college for getting MPO registration should not be declared illegal.

The High Court bench of Justice M Enayetur Rahim and Justice Md Mostafizur Rahman passed the order on Sunday after hearing a writ petition filed by 291 lecturers and other employees of different degree level colleges across the country.

Education Secretary (Secondary and Higher Education Division), Director General of the Directorate of Secondary and Higher Education Division (DSHE) and two other respondents have been asked to comply with the ruling.

Lawyer Siddique Ullah Miah appeared in the court on behalf of the writ petitioners, while Deputy Attorney General Bepul Bagmar represented the state.

'Manpower Structure and MPO Policy-2021' enacted for private educational institutions (schools and colleges) imposed a condition that there should be at least two departments in degree level (pass) colleges for getting MPO enrolment, according to the writ petition.

Since the petitioners' colleges have only one department, they could not apply for MPO enrolment even after working for a long time, said the petitioners’ lawyer.

The lawyer also said, “The petitioners have legal right to get the opportunity of applying for the MPO enrolment. But the condition of the policy is deceiving them to apply for that.”

Mr Siddique Ullah Miah said policies enacted in 2013 and 2018 did not impose any such condition as a result the lecturers and other employees got scope to apply for MPO enrolment.
