The High Court has asked the building owner of the Evaly office to extend his all-out cooperation to the court-appointed board of directors of the organisation and their appointed auditor to carry out its audit work. He has also been asked to appear before the court when the court will call him.
The High Court bench of Justice Muhammad Khurshid Alam Sarkar passed the order after hearing the building owner, Sheikh Salauddin, who appeared in the court on Thursday complying with its earlier order.
The court on February 17 summoned Sheikh Salauddin, owner of the building where the Evaly’s office is located, to appear in person in the court on February 24, failing which the law enforcing agencies shall be directed to arrest him and produce before the court.
Meanwhile, the court has also recorded an application filed by Md Farhad Hossen, a consumer of the Evaly who filed the petition seeking High Court directives for winding up of the organization, stating that he was being threatened through different online media including Facebook.
Lawyer Abdur Razzak appeared in the court on behalf of Sheikh Salahuddin, while lawyer Syed Mahsib Hossain appeared for Farhad Hossen.
On February 17 the High Court also allowed the controversial e-commerce platform’s former chairman Shamima Narsin and its former managing director and chief executive officer Mohammad Rassel to transfer 50 percent of their shares to three family members for running the company.
The three members are--- Shamima Nasrin’s father Rafiqul Alam Talukder, her mother Farida Talukder Lily, and her sister’s husband Md Mamunur Rashid.
The DIG prisons concerned have been directed to extend necessary cooperation in completing the process for transferring the shares of Shamima and Rassel, as both of them are now behind the bar.
The same HC bench passed the order after hearing an application filed by Rafiqul, Farida, and Mamunur saying that they are interested to take over the responsibility of the company for its revival.
In the application, they prayed to the HC to allow Shamima and Rassel to transfer some of their shares of the company to them for this purpose.
In the order passed on Thursday, the HC said Rafiqul, Farida and Mamunur cannot transfer or sale any share to any other person after receiving the shares from Nasrin and Russel.
The court also said the court-appointed Board of Directors of the Evaly will determine the role of Rafiqul, Farida, and Mamunur in operating the company. The family members shall extend their cooperation to the auditor appointed by the court-appointed Board of Directors to carry out its audit works.
The court also directed the former executive director of the Evaly Ehsan Sarwar Chowdhury to extend his cooperation to the auditor appointed by the court-appointed Board of Directors to carry out its audit work.
Earlier on February 7, the same court asked fathers, mothers, sisters, brothers, sons, daughters-in-law of ex-CEO Russel and ex-chairman Nasrin to show cause within two weeks as to why all types of bank accounts of the fathers, mothers, sisters, brothers, sons, daughters-in-law of ex-CEO Russel and ex-chairman Nasrin shall not be frozen.
Following a petition filed by Md Farhad Hossen the same High Court bench on September 22 in 2021 directed the concerned bodies to be restrained from selling, transferring, or otherwise disposing of the assets of the Evaly till disposal of the case filed with the High Court.
Later the court on October 18 in 2021 formed a 5-member body to oversee the overall management and the company affairs of Evaly Limited.
