The High Court on Tuesday observed that the Brahmanbaria Bar Association has created a black mark in the legal history of the country. They have disgraced all the lawyers by posing muscle, also observed the court.
The High Court bench of Justice JBM Hassan and Justice Razik-Al-Jalil passed the observation while hearing a Suo Motu (on its own motion) rule issued over misconduct of the lawyers of the district bar with the judge of the district Woman and Child Repression Prevention Tribunal.
Meanwhile, three lawyers of the Brahmanbaria Bar including its President Md Tanvir Bhuiyan appeared in the High Court complying with High Court’s earlier order. Two other lawyers are Md Akkas Ali and Zubayer Islam.
Sources said, a group of lawyers of the Brahmanbaria Bar on January 2 this year created chaos in the courtroom of the district Woman and Child Repression Prevention Tribunal and misbehaved its judge with abusive words.
Considering the issue, the High Court on January 5 summoned the President of Brahmanbaria Bar and two other lawyers, directing them to appear before it on January 17 for placing their explanation over the incident.
The lawyers appeared before the High Court bench on that day, however, sought more time for submitting their explanation. Accordingly, the HC bench fixed February 14 for further hearing on the issue.
Supreme Court Bar Association (SCBA) President Md Momtazuddin Fakir, Secretary Abdun Nur Dulal and Senior Advocate Sayed Ahmed Raza and Advocate Shah Monjurul Hoque appeared in the court hearing on behalf of the laywers, while Deputy Attorney General Tushar Kanti Roy represented the state.
During the hearing on Tuesday the court said, “We issued the rule on January 5. You didn’t submit any affidavit yet. You are wasting time. You have to face the consequence of that. We will not grant more time. You can give an explanation or not. We will move forward as we are.”
The court also said, “We have granted you one month time with good faith. However, you did nothing by this time. Rather you crippled the courts of the district which are the Constitutional organisations.”
Lawyer Momtazuddin Fakir then said “sorry my lord”. Lawyer Abdun Nur Dulal said, “There is a development. All the stakeholders held a meeting.”
At one stage the HC bench said, “Lawyers of the Brahmanbaria Bar Association have created a black mark in the legal history of the country. They have disgraced all the lawyers by posing muscle. No one is above the law, may be it the President of the association or the general members. There is a bar council. If the Bar Council doesn't take any action, we will do it from here.”
Then Momtazuddin Fakir prayed to the court to grant them time till March for placing their explanations regarding the incident. However, the High Court bench fixed February 26 for further hearing on the issue.
