16th amendment verdict review in December: AG

The review petition against the Supreme Court verdict on the 16th amendment of the Constitution will be filed in December, said Attorney General Mahbubey Alam on Tuesday.

"We found the certified copy of the Appellate Division verdict that scrapped the 16th amendment of the constitution on Monday. So, we have 28 days more time in hand. I hope, we will file the review in December," Alam said while talking to journalist at his office, reports UNB.

The AG also said "Seven justices of the Appellate Division heard the main appeal. Now, the number of justices is five in the Appellate Division. As per the rules of the review petition, either equal number or more justices are needed to hear the review petition."

There is no possibility of hearing until new justices are appointed at the Appellate Division.

On November 4, Law Minister Anisul Huq said the review petition would be filed within this month.

On August 1, the Supreme Court released the full text of its verdict upholding the High Court verdict that declared illegal the 16th amendment to the Constitution establishing parliament's authority to remove Supreme Court judges.

The parliament passed the 16th amendment on September 17, 2014.

On May 5 last year, the HC declared the 16th amendment illegal. The government on January 4 last filed an appeal with the apex court challenging the HC decision.

On July 3, the Appellate Division, led by Chief Justice Surendra Kumar Sinha, upheld the HC verdict.
